MySA.com: The next big mulch fire battle will be over who’s going to pay

If everything goes as planned, the state’s environmental agency should be sending Henry Zumwalt a fire cleanup bill in a couple of weeks.

By then, we’re told, the fire that’s been burning on Zumwalt’s property since Dec. 26 should be extinguished.

What kind of bill can Zumwalt expect?

In mid-January, the Texas Commission on Environmental Quality pegged the cost at $1.75 million.

Three fire-fighting plans and multiple delays later, the projected bill jumped to $3 million two weeks ago.

Today, TCEQ says the cost will be more than $3 million.

Whatever the final tally, Zumwalt does not intend to pay, which means he and the state are headed for court.

Why do I get the feeling that it’s me that is going to pay? Even if the courts decide Zumwalt is responsible how are they going to get the money? Maybe I am wrong and he has an amazing insurance policy that will pay the state back for this but I sure wouldn’t be counting on that money.

  1. Who is this guy? The state could get a judgment, then file a lien against his assets to collect the money. However, I’ve been wondering how the hell this moron ended up with this stuff in the first place and what he intended to do with it.

  2. Henry Zumwalt is the owner of Zumwalt Construction. The company that owns the land and created the mulch heap. I don’t know if they will be able to get a judgement. It will depend on if the state can prove that the fire was due to his negligence and not an illegal act. It seems pretty cut and dried that if he didn’t make a pile that large that no giant mulch fire would have happened but that isn’t always how a judge or jury sees it. I think it will depend on how good his lawyer is.

    As for filing a lien against his assets, I can see him easily putting that business into bankrupcy and opening it under another name, without ever having to pay a dime. What a mess.

  3. I think we are way way premature on trying to decide who will pay…. This is like the Fires of Hell it will never be put out!!!!!

    If we want the fire out we will have to sell our souls to the Devil,,,,, Remember the Yankees….
