Balous Miller is against the Constitution
The Helotes Heritage Association has responded to a lawsuit filed by Balous Miller against the mayor of Helotes, past and present members of Helotes City Council and the HHA by hiring a team of defense attorneys and counter-filing against Miller.
Miller, president of the Bill Miller chain, is accusing the defendants of civil conspiracy and interference and alleging that the defendants’ actions caused Wal-Mart to abandon its plans to build a store at the intersection of Texas 16 and Scenic Loop Road.
I just hope they have the resources to see this through. Balous Miller is suing because a loss of potential income. So should employee union organizers be allowed to sue when they don’t get their union because of public statements by a corporation? Or how about tax payers who end up subsiding tax breaks for economic development when a business convinces governments to give them a deal to locate in a specific area? Maybe homeowners who live in the area affected by corporate pollution because government reduced environment regulations should be able to sue for the loss market value of their property. Oh wait a minute, I forget, government is only supposed to protect the interests of business and wealth, not the average voter.
Let’s just hope the First Amemendment angle works out.
The HHA responded in a statement: “There appears to be no doubt that this lawsuit is meant to punish the HHA for having exercised its constitutionally guaranteed rights of free speech, peaceful assembly and petitioning of their government as well as to quiet any future opposition to Miller’s development plans.”
